License Grant
This License Agreement (“Agreement”) applies to the emonster software presented on emonster travel—currently SkyStamp, Vintokyo, and Price Tag FX—and related updates, features, documentation, and services provided by emonster inc. (“emonster,” “we,” “us,” or “our”), unless a product-specific license or written agreement states otherwise. By downloading, installing, accessing, or using the applicable emonster software, you agree to this Agreement.
Subject to this Agreement, emonster grants you a limited, revocable, non-exclusive, non-transferable license to install and use the applicable software on devices you own or control, only for lawful personal, business, or internal use as permitted by the product and its distribution channel.
The software is licensed, not sold. You do not acquire ownership of the software or any emonster intellectual property.
Restrictions
You may not copy, modify, adapt, translate, sell, rent, lease, sublicense, distribute, host, outsource, or create derivative works from the software except as expressly permitted by law or by written permission from emonster. You may not reverse engineer, decompile, disassemble, bypass technical protections, remove proprietary notices, misuse APIs or data, interfere with service operation, or use the software for unlawful, infringing, harmful, or abusive purposes.
Ownership
emonster and its licensors retain all rights, title, and interest in and to the software, documentation, designs, code, trademarks, service marks, inventions, patents, content, and related intellectual property. All rights not expressly granted are reserved.
App Store and Platform Terms
If you obtained the software through Apple or another app marketplace, your use is also subject to that marketplace’s terms. For iOS, iPadOS, macOS, watchOS, tvOS, and visionOS apps, Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
Updates and Availability
emonster may provide updates, fixes, or new versions, but is not obligated to do so unless required by applicable law or a separate written agreement. Features may change, be suspended, or be discontinued. Some features may require internet access, third-party services, app marketplace availability, or a compatible device and operating system.
Privacy and Data
The Privacy Policy explains information handling and optional analytics for the emonster travel website. Information processed by the applicable software is governed by any product-specific privacy disclosures and the terms of its distribution platform. emonster travel does not change or replace those disclosures.
Support
Product support questions may be sent to support@emonster.com or through the product destinations linked from emonster travel. Support availability may vary by product, platform, and app marketplace.
No Warranty
The software is provided “as is” and “as available.” To the maximum extent permitted by law, emonster disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and error-free operation.
Limitation of Liability
To the maximum extent permitted by law, emonster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, device failure, or loss of goodwill arising out of or related to the software. Rights and remedies that cannot lawfully be excluded or limited remain unaffected.
Termination
This Agreement remains effective until terminated. Your rights under this Agreement terminate automatically if you violate it. Upon termination, you must stop using and uninstall the applicable software and delete any copies in your possession or control.
Export and Legal Compliance
You are responsible for complying with applicable export control, sanctions, privacy, intellectual property, and other laws that apply to your use of the software.
Governing Law
This Agreement is governed by the laws of the State of Washington, without regard to conflict-of-law principles, unless a written agreement with emonster states otherwise.
